1. Definitions

• "CueGuest" means the platform available at cueguest.com, operated by Jarred Smith trading as CueGuest, based in South Africa.
• "Service" means the digital guest guide creation, management, and delivery platform provided by CueGuest.
• "Host" means any individual or business that creates an account and uses CueGuest to create and share guides.
• "Guest" means any individual who accesses a guide via a shared link, with or without an account.
• "Guide" means a digital property information page created by a Host using the Service.
• "Content" means any text, images, links, instructions, or other material uploaded or created by a Host within the Service.
• "Third-Party Platform" means any external booking or rental platform including but not limited to Airbnb, Booking.com, Vrbo, and similar services.

2. The Service

CueGuest provides a software-as-a-service (SaaS) platform that enables short-term rental hosts to create structured digital guest guides. Guides may include check-in instructions, house rules, Wi-Fi credentials, local recommendations, checkout procedures, and other property-related information.

CueGuest is a technology platform only. We are not a rental platform, a booking agent, a property manager, or an agent of any Host or Guest. We do not participate in, facilitate, or take responsibility for any rental transaction, property booking, or host-guest relationship.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to Hosts.

3. Eligibility

You must be at least 18 years of age to create a CueGuest account and use the Service as a Host. By registering, you represent and warrant that you meet this requirement.

The Service is available globally, subject to any applicable local laws or regulations. It is your responsibility to ensure your use of the Service complies with the laws of your jurisdiction.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@cueguest.com if you suspect unauthorised access.

You agree to provide accurate, current, and complete information when creating your account and to keep this information up to date.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or cause harm to other users or to CueGuest.

5. Trial Period, Billing, and Refunds

Free Trial

New Host accounts receive a free trial that includes the ability to send up to 10 guest guide links at no charge. No payment information is required to access the free trial.

Once the free trial limit is reached, you will be invited to enter your payment details and subscribe to a paid monthly plan to continue using the Service.

Paid Subscription

Following the free trial, access to the Service requires a recurring monthly subscription. By subscribing, you authorise CueGuest to charge your nominated payment method on a monthly basis via Stripe.

• Subscriptions automatically renew each month unless cancelled before the renewal date
• You may cancel your subscription at any time via your account settings or by contacting us
• Cancellation takes effect at the end of the current billing period; you retain access until that date
• Pricing may change with 30 days' notice to registered Hosts by email

No Refunds

Payment Processing

Payments are processed by Stripe. By providing payment details, you also agree to Stripe's Terms of Service. CueGuest does not store your full card details.

6. Acceptable Use

You agree not to use CueGuest to:

• Upload or share content that is unlawful, defamatory, discriminatory, obscene, or harmful
• Infringe the intellectual property rights of any third party
• Distribute malware, spam, or any form of harmful code
• Attempt to gain unauthorised access to other accounts or CueGuest systems
• Use the Service in any way that violates the terms of service of any Third-Party Platform
• Scrape, copy, or redistribute CueGuest's technology or intellectual property
• Use the Service for any purpose other than legitimate short-term rental property management
• Misrepresent your identity, property, or affiliation with any organisation

Violation of these rules may result in immediate account suspension or termination without refund.

7. Third-Party Platforms and Independence

All product names, logos, and trademarks of third-party platforms are the property of their respective owners. References to these platforms are for descriptive purposes only.

Your Responsibility Regarding Third-Party Platform Terms

If you use CueGuest in connection with properties listed on Third-Party Platforms, you are solely responsible for ensuring that your use of CueGuest complies with the terms of service, community policies, and applicable rules of those platforms. CueGuest accepts no responsibility for any consequences arising from a Host's violation of any Third-Party Platform's terms of service.

Imported Content

CueGuest may offer features that assist Hosts in importing publicly available information from external sources to pre-populate guides. By using such features, you represent and warrant that:

• You have the legal right to use the content you import or reference
• Your use of any imported content complies with applicable intellectual property law and any relevant platform's terms of service
• You will not use CueGuest to systematically scrape, harvest, or misappropriate data from any third-party platform in violation of that platform's terms

CueGuest expressly disclaims any liability arising from a Host's use of imported or referenced third-party content.

No Endorsement

CueGuest does not endorse, verify, or take responsibility for any information, instructions, or content that Hosts create in their guides. Guests access guide content at their own discretion.

8. Your Content

You retain ownership of all Content you create and upload to CueGuest. By uploading Content, you grant CueGuest a non-exclusive, worldwide, royalty-free licence to host, store, display, and deliver your Content solely for the purpose of operating the Service.

You are solely responsible for the accuracy, legality, and appropriateness of all Content in your guides. CueGuest does not review or verify guide content and accepts no liability for any harm arising from inaccurate, misleading, or dangerous content in a guide.

You warrant that your Content does not infringe any third-party intellectual property rights and that you have all necessary permissions for any images, text, or other material you upload.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CueGuest, its operator, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Loss of revenue, profit, data, goodwill, or business opportunity
• Any harm to a Guest arising from following instructions or information in a Host's guide
• Any property damage, personal injury, or loss arising from a Host-Guest interaction
• Service interruptions, data loss, or technical failures
• Any consequences arising from a Host's violation of a Third-Party Platform's terms of service
• Any actions taken by Third-Party Platforms against a Host in connection with their use of CueGuest

Where liability cannot be excluded by law, CueGuest's total aggregate liability to you for any claim shall not exceed the total amount paid by you to CueGuest in the three (3) months immediately preceding the event giving rise to the claim.

Guest Safety and Host Responsibility

Hosts are solely responsible for the accuracy and safety of all instructions and information in their guides. CueGuest is not responsible for any injury, loss, or damage suffered by a Guest as a result of following guide content. Hosts should ensure that all safety information, access instructions, and property details are accurate, current, and legally compliant.

10. Indemnification

You agree to indemnify, defend, and hold harmless CueGuest and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any Third-Party Platform's terms of service
• Any claim by a Guest arising from your guide content
• Any intellectual property infringement arising from content you submit

11. Termination

You may close your account at any time by contacting us at hello@cueguest.com. Closing your account will cancel your subscription at the end of the current billing period. No refunds will be issued for the remaining portion of the subscription period.

CueGuest reserves the right to suspend or terminate your account immediately and without notice if you:

• Breach these Terms
• Engage in fraudulent, abusive, or illegal conduct
• Cause harm to other users, guests, or to CueGuest
• Fail to pay subscription fees when due

Upon termination, your right to use the Service ceases immediately. Your Content may be deleted after 90 days following termination. Provisions of these Terms that by their nature should survive termination shall do so, including sections on Liability, Indemnification, and Governing Law.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall first be subject to good faith negotiation. If unresolved, disputes shall be submitted to the jurisdiction of the courts of South Africa.

For users in the European Union, nothing in these Terms limits your rights under applicable EU consumer protection law. For users in other jurisdictions, applicable mandatory local consumer law may apply and is not excluded by these Terms.

13. Changes to These Terms

CueGuest reserves the right to update these Terms at any time. When we make material changes, we will notify registered Hosts by email at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.
